Article 1 – Purpose
These General Terms and Conditions of Sale and Use (GTCU) define the rights and obligations of any person visiting and using the website published on the WIX platform (hereinafter “the Site”).
They govern:

Article 2 – Publisher and Hosting

Article 3 – Geographic Scope and Contract Languages
The Site is accessible from Belgium, France, and the entire European Union. The GTCU are written in French. Versions in Dutch and English are available upon request. In case of discrepancy, only the French version shall prevail.
Article 4 – Definitions

Client: Any adult natural person or legal entity acting as a consumer or buyer in Belgium, France, or the EU

Product: Goods offered for sale on the Site

Account: Secure space accessible via login credentials (email/password) allowing the Client to manage orders and data

Workshop: Training or entertainment session available for online booking
Article 5 – Account Creation and Management
To place an order or book a workshop, the Client must create an Account by providing:

Title, last name, first name

Postal address (Belgium, France, or other EU country)

Email address

Phone number

Password
The Client agrees to provide accurate and up-to-date information.
Any changes must be made via the “My Account” section.
If the password is lost, the “Forgot Password” function allows reset.
Article 6 – Products and Workshops
6.1 Product Presentation
Each product page includes:

A detailed description

Price including VAT (VAT added at checkout at the Belgian rate of 21%)

Availability (in stock or restocking delay)
6.2 Workshop Booking
Workshops are offered according to an online calendar. The Client selects a date, pays online, and receives confirmation by email.
Article 7 – Prices, VAT, and Payment Terms
Prices are expressed in euros, excluding VAT.
As a Belgian company, the applicable VAT rate is 21% (unless exceptions apply).
For cross-border sales within the EU (outside Belgium), Belgian VAT is charged unless OSS thresholds are exceeded; in that case, the destination country’s VAT applies via the One-Stop Shop (OSS).
Shipping fees are calculated based on weight, destination (Belgium, France, EU), and carrier.
Payment is made online via:

Any other method offered on the Site
Orders are confirmed upon receipt of payment.
A confirmation email summarizing the order or booking is sent to the Client.
Article 8 – Shipping and Delivery
Products are shipped within 3 to 5 business days after order confirmation.
Estimated delivery times after shipment:

Belgium, Luxembourg, Netherlands: 1–2 business days

Germany: 2–3 business days

France, Denmark, Italy, Austria, Poland, UK: 2–4 business days

Other EU countries upon request
Delivery tracking is sent by email.
In case of delay, the Client may contact customer service for detailed follow-up.
Article 9 – Right of Withdrawal and Returns
In accordance with Belgian law and the French Consumer Code, the Client has 14 calendar days to exercise the right of withdrawal from the date of product receipt.
This right does not apply to services fully performed before the end of the withdrawal period (workshops).
Products must be returned complete, in perfect condition, and in original packaging.
Return costs are borne by the Client, except in cases of defective or non-compliant products.
Refunds are issued within 14 days after receipt and inspection of the returned product.
Article 10 – Personal Data
Collected data: name, surname, address, email, phone number, order and booking history
Purpose: order management, bookings, invoicing, after-sales service
Compliance: GDPR, Belgian law of 30 July 2018 on personal data protection
Rights: access, rectification, deletion, portability, and objection by contacting contact@brasserie-carre.com or the Belgian Data Protection Authority

Article 11 – Cookies
The Site uses cookies to:

Clients can manage preferences via the cookie banner in compliance with Belgian and EU regulations.
Article 12 – Intellectual Property
All content (texts, images, logos, videos) is protected by Belgian and European copyright law.
Any full or partial reproduction is prohibited without written permission from the publisher.
Article 13 – Liability
The publisher makes every effort to ensure the accuracy of information but cannot guarantee the absence of errors.
The publisher is not liable for indirect damages related to Site use or access issues.
For workshops, liability is limited to the amount paid in case of cancellation by the publisher.
For cross-border disputes, the Brussels I bis Regulation applies.
Article 14 – Force Majeure
Parties’ obligations are suspended in cases of force majeure (strike, natural disaster, internet outage, etc.) making performance impossible.
Article 15 – Governing Law and Disputes
These GTCU are governed by Belgian law.
In case of dispute, an amicable solution is sought.
Failing that, the competent court is that of the publisher’s registered office or, for consumers, their place of residence.
